Construction Accident
Our client was a construction worker, offloading rebarb in a building site where additional floors were being added. He fell through an open hole in the floor, which was supposed to be secured by a railing and/or covered. He sustained a badly fractured wrist, requiring an external fixation device, and injured his back, for which he had a TENS unit surgically implanted.
He retained the firm, and we commenced an action against the building owner, the contractor, and the subcontractors. Despite initial strong opposition from the defendants, after all defendants’ depositions were taken, we won the case on a summary judgment motion and the matter was set down for trial. On the first day of jury selection, the case was settled for all of the available policy coverage of $2 million.
Slip & Fall
Our client was shopping at the local supermarket. One of the refrigerators leaked water into the aisle, which we were able to establish would happen on a regular basis. She slipped, twisting her knee and injuring her back, including a herniated disk.
The defendants fought the case, arguing that they had no prior notice of the refrigerator’s condition. Through independent investigation and witness deposition of a serviceperson, we were able to prove that this was in fact a known problem. As a result, the defendants ultimately agreed to settle the matter before trial, paying $625,000.
